Terms of Service

Welcome to Invideos. Invideos is operated by WHALEPLUS PTE. LTD. (“we,” “us,” “our,” or the “Company”).

By accessing, registering for, or using the Invideos website, applications, AI image generation, AI video generation, video upscaling, or other related services, you acknowledge that you have read, understood, and agreed to these Terms of Service. If you do not agree to these Terms, please stop using Invideos.

Our Services

Invideos provides services including, but not limited to:

• AI image generation;
• AI video generation;
• Video upscaling and resolution enhancement;
• AI models and creative tools;
• Membership subscriptions and credit purchases;
• Generation task management, generation history, and related features.

We may modify certain models, parameters, resolutions, durations, features, or forms of service based on technical capabilities, third-party model providers, product updates, legal requirements, or operational needs.

The availability of certain features may vary depending on your location, membership status, system capacity, or third-party service availability.

Accounts and Access

Certain services require you to register for or sign in to an account.

You are responsible for:

• Providing true, accurate, and complete information;
• Keeping your account and login credentials secure;
• All activities conducted through your account;
• Contacting us promptly if you discover unauthorized access, unusual activity, or misuse of your account.

You must not:

• Register or use an account under another person’s identity;
• Sell, rent, transfer, or unlawfully share an account;
• Use another person’s payment method without authorization;
• Use technical means to bypass account, credit, feature, duration, or concurrency restrictions.

We may verify, restrict, or suspend accounts that present security, fraud, or abnormal-use risks.

User Inputs and Responsibilities

Any text, prompts, images, videos, audio, reference materials, or other content you upload, enter, or submit to Invideos must either belong to you or be used with all necessary permissions.

You are responsible for:

• Your input content and uploaded materials;
• Generation tasks initiated through your account;
• Downloading, publishing, distributing, or otherwise using generated outputs;
• Any personal or commercial use of generated outputs.

You must ensure that:

• Your input and reference materials are lawfully obtained;
• You have obtained all necessary permissions relating to likenesses, voices, copyrights, trademarks, and other protected rights;
• Your generation and use of content do not infringe the rights of any third party;
• Your generation and use of content comply with applicable laws and regulations;
• You review generated outputs before publishing or using them commercially.

Prohibited Content and Conduct

You must not use Invideos to create, process, distribute, download, or commercially exploit any of the following content.

4.1 Children and Minors

You must not generate or process:

• Child sexual abuse material, sexualized depictions of children, or sexual content involving minors;
• Nudity, intimate body parts, sexual activity, or sexual abuse involving minors;
• Content that places minors in adult, dangerous, violent, or clearly inappropriate situations;
• Content that exploits, manipulates, harasses, grooms, or harms children or minors;
• Pornographic, sexualized, or otherwise inappropriate deepfakes involving minors.

Such content is prohibited even if a user claims to have obtained consent from a parent or guardian.

4.2 Pornographic and Sexually Exploitative Content

You must not generate:

• Explicit pornography or depictions of sexual activity;
• Nudity or sexualized content primarily intended for sexual gratification;
• Sexual violence, coercion, non-consensual sexual content, or sexual exploitation;
• Pornographic or sexualized content depicting a real person;
• Any sexual content involving a minor.

4.3 Violence, Self-Harm, and Dangerous Activities

You must not generate:

• Extremely graphic violence, dismemberment, torture, abuse, or cruelty;
• Content that encourages self-harm, suicide, harm to others, or dangerous challenges;
• Content that glorifies, encourages, or incites real-world violence;
• Instructions for manufacturing weapons, explosives, illegal drugs, or other dangerous materials;
• Practical instructions that facilitate crime, terrorism, or other illegal activities;
• Content falsely depicting a real person as injured, dead, committing a crime, or experiencing violence.

Content presented for news, educational, historical, or artistic purposes must not clearly encourage, glorify, or incite violence.

4.4 Religion and Belief

General religious, historical, cultural, and artistic content may be permitted. However, you must not generate:

• Content that insults, degrades, or maliciously attacks a religion, denomination, belief, or its followers;
• Content promoting religious hatred, discrimination, persecution, or violence;
• Maliciously altered or degrading depictions of religious figures, places, scriptures, or ceremonies;
• Content impersonating religious organizations, religious leaders, or clergy for deception or fraudulent fundraising;
• Content intended to incite religious hostility, group conflict, or real-world harm.

Religious figures, symbols, and places must be represented respectfully and without insult or incitement.

4.5 Real Persons, Likenesses, and Deepfakes

You must not:

• Use another person’s likeness, name, voice, or identity without the necessary authorization;
• Create misleading deepfakes of real people, celebrities, public figures, or political figures;
• Falsely depict a person making statements, committing a crime, participating in sexual activity, or experiencing harm;
• Present AI-generated content as authentic news, official statements, evidence, or real-world events;
• Use generated content for fraud, extortion, harassment, defamation, impersonation, or manipulation.

4.6 Political and Public-Event Content

You must not generate:

• Fabricated statements attributed to political figures, government agencies, or official media organizations;
• False information about elections, voting, public safety, or emergencies;
• Political content intended to deceive or manipulate the public;
• Content inciting hatred, group hostility, riots, or real-world harm;
• Content impersonating governments, law enforcement agencies, courts, healthcare institutions, or other authorities.

4.7 Illegal, Fraudulent, and Infringing Content

You must not generate:

• Content related to fraud, phishing, money laundering, theft, or other illegal activity;
• Forged identification documents, contracts, invoices, certificates, payment records, or official documents;
• Content that infringes copyright, trademarks, patents, trade secrets, or other intellectual property rights;
• Content that violates privacy, discloses personal information, or facilitates harassment or stalking;
• Content that violates applicable laws, regulatory requirements, or third-party platform rules.

4.8 Misleading Commercial and Professional Content

You must not generate:

• False advertisements, fake reviews, fabricated testimonials, or misleading product results;
• Content impersonating doctors, lawyers, financial institutions, or other professionals;
• Misleading content likely to influence significant medical, legal, financial, or safety decisions;
• Unauthorized uses of brands, trademarks, product packaging, or other commercial materials.

4.9 Circumvention and Abuse

You must not:

• Use altered wording, encoding, split prompts, embedded images, or other means to bypass safety reviews;
• Exploit vulnerabilities, automation tools, or abnormal methods to obtain credits or services;
• Maliciously consume system resources or interfere with normal platform operation;
• Reverse engineer, hack, scrape, or imitate Invideos;
• Resell or misuse accounts, membership benefits, or credits.

Content Review and Enforcement

To protect platform safety and comply with applicable laws, we may use automated systems and human review to identify risks in input content, generation requests, and outputs.

If content may violate these Terms or present a safety risk, we may:

• Refuse to generate it;
• Suspend, cancel, or delay the task;
• Remove or restrict access to the relevant content;
• Restrict models, features, durations, concurrency, or account permissions;
• Suspend or terminate the account;
• Revoke credits obtained through fraudulent, abnormal, or prohibited means;
• Report relevant matters to competent authorities where required by law or necessary for safety.

Review systems are not always accurate. The fact that content passes our systems does not mean that it is lawful, approved by us, or safe to use.

AI-Generated Outputs

AI-generated outputs may contain errors, biases, omissions, repetition, inaccuracies, or similarities to existing content.

We do not guarantee that:

• Generated outputs will always be accurate or meet all your expectations;
• Generated outputs will be unique or exclusive;
• Generated outputs will not resemble third-party content;
• Generated outputs will qualify for copyright or other intellectual property protection;
• Generated outputs will be suitable for any particular commercial, advertising, or professional purpose;
• Every model and feature will remain continuously available.

Different users may receive identical or similar outputs. Before publishing, distributing, or commercially using any output, you are responsible for reviewing its accuracy, legality, intellectual property status, and suitability.

AI-generated outputs must not be used as the sole basis for medical, legal, financial, safety, or other professional decisions.

Intellectual Property

The Invideos website, applications, trademarks, interfaces, text, graphics, designs, code, product structure, and other platform materials are owned by WHALEPLUS PTE. LTD. or the relevant rights holders.

Without prior written permission, you must not:

• Copy, modify, sell, rent, or transfer platform materials;
• Reverse engineer, decompile, or attempt to obtain source code;
• Scrape, mirror, or copy platform data in bulk;
• Use our brand, interfaces, or content to create an imitation product;
• Otherwise infringe our rights or the rights of relevant third parties.

You retain any rights you lawfully hold in your input content. You grant us the permissions necessary to process that content for the purposes of providing, maintaining, improving, and protecting the Services.

Subject to applicable law and third-party model rules, you may use content generated through Invideos. However, we do not guarantee that generated content carries complete, exclusive, or registrable intellectual property rights.

You are responsible for ensuring that your use of generated content does not infringe any third party’s likeness, privacy, copyright, trademark, or other rights.

Third-Party Models and Services

Certain Invideos features are provided through third-party AI model providers, cloud providers, storage providers, payment processors, or other technology service providers.

Third-party services may have their own:

• Terms of use;
• Content safety policies;
• Commercial-use restrictions;
• Data-processing practices;
• Service availability arrangements;
• Data-retention periods.

If the rules applicable to a particular third-party model or service are more restrictive than these Terms, you must also comply with those stricter rules.

Failures involving third-party models, APIs, servers, networks, or payment services may cause generation tasks to fail, become delayed, change in availability, or become temporarily unavailable.

Subscriptions, Credits, and Payments

Invideos may offer trials, automatically renewing subscriptions, memberships with different billing periods, and credit purchases.

The applicable price, billing period, membership benefits, number of credits, credit validity period, plan-change rules, and other conditions will be displayed when you purchase or confirm the relevant transaction.

Certain trial offers automatically convert to paid subscriptions when the trial period ends. Before payment, the purchase page will display the trial duration, initial charge, subsequent renewal price, and billing period. By completing the purchase, you authorize us or the relevant payment processor to charge the displayed amount according to the displayed billing schedule.

Generation services may consume credits based on the selected model, resolution, video duration, number of outputs, and other parameters. The estimated credit cost will be shown before generation, while the final charge will be based on the actual task settlement.

The validity, deduction priority, and usage restrictions applicable to subscription credits and separately purchased credits are governed by the information displayed on the purchase page and the applicable credit rules.

When a plan is upgraded or changed, its effective time, treatment of existing fees and remaining credits, membership period, and renewal arrangement will follow the information displayed and confirmed during that transaction.

Stopping future renewals and requesting a refund are separate matters. Refund eligibility, request deadlines, usage thresholds, and the treatment of benefits following a refund are governed by our Refund Policy.

Failed Tasks and Credit Adjustments

For tasks that require credits:

• We may deduct the estimated credit amount before generation begins;
• Successful tasks will be settled according to their final actual usage;
• Excess deductions will be returned in accordance with system rules;
• If actual usage exceeds the amount initially deducted, the difference may be charged;
• If a task fails due to the system or model, credits that were deducted but not actually consumed will be returned;
• If a task fails because of prohibited content or because the user stops it, the applicable interface and credit rules will determine whether credits are returned.

Specific consumption and refund rules are governed by the information displayed when the task is confirmed and by the applicable plan and credit rules.

Account Restrictions, Suspension, and Termination

If you violate these Terms, misuse the Services, engage in fraud, circumvent restrictions, infringe the rights of others, or create risks for the platform or other users, we may:

• Restrict generation, download, or purchasing features;
• Suspend your account or related Services;
• Remove or restrict access to relevant content;
• Revoke credits obtained through fraud, vulnerabilities, or abnormal means;
• Terminate your account;
• Take other measures required by applicable law.

Account suspension or termination due to serious violations, fraud, malicious attacks, or exploitation of vulnerabilities does not automatically entitle you to a refund. Refund matters will be handled under our Refund Policy and applicable law.

Expired subscription credits will not be restored.

Service Changes, Suspension, and Discontinuation

We may modify, suspend, or restrict part of the Services due to:

• System maintenance or technical upgrades;
• Model-provider changes or API failures;
• Cloud, network, or payment-service failures;
• Security incidents or cyberattacks;
• Legal, regulatory, or compliance requirements;
• Force majeure or other circumstances beyond our reasonable control.

We will take reasonable steps to restore the Services. Tasks that fail and remain incomplete due to system issues will be handled under the applicable credit-return rules.

We may also discontinue certain models, parameters, or features and, where reasonably practicable, provide appropriate notice.

Complaints, Infringement Notices, and Content Removal

If you believe that content created or distributed through Invideos infringes your likeness, privacy, intellectual property, or other legal rights, contact us at:

Your notice should, where possible, include:

• Your name and contact details;
• A link, screenshot, or task information identifying the disputed content;
• Evidence of your rights or authorization;
• A description of the alleged infringement;
• The action you would like us to take.

We will review the submitted information, relevant system records, platform rules, and applicable law. Where appropriate, we may restrict access, remove content, suspend an account, or take other reasonable measures.

Disclaimers

Invideos is provided on an “as is” and “as available” basis.

To the maximum extent permitted by applicable law, we do not guarantee that:

• The Services will always be continuous, timely, secure, or error-free;
• All models, parameters, and features will always remain available;
• Generated outputs will be accurate, complete, unique, or suitable for a particular purpose;
• Generated outputs will not infringe third-party rights;
• Third-party models, networks, or payment services will operate without interruption;
• Users will achieve any expected commercial or creative outcome through the Services.

You are responsible for determining whether generated outputs are suitable for publication, distribution, or commercial use.

Limitation of Liability

To the maximum extent permitted by applicable law, WHALEPLUS PTE. LTD. will not be liable for indirect, incidental, special, consequential, or similar losses, including loss of profits, data, goodwill, or business interruption, arising from:

• Your use of or inability to use Invideos;
• Errors, omissions, or unexpected results in AI-generated outputs;
• Disputes resulting from your inputs, publication, or use of generated content;
• Failures involving third-party models, networks, cloud services, or payment processors;
• Your violation of these Terms or applicable law;
• Force majeure or other circumstances beyond our reasonable control.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law.

Governing Law and Dispute Resolution

These Terms are governed by the laws of Singapore, without limiting any mandatory consumer protection rights available under the laws of your jurisdiction.

If a dispute arises between you and us, both parties should first attempt to resolve it through good-faith communication by email.

If the dispute cannot be resolved through discussion, it may be submitted to a court of competent jurisdiction or another applicable dispute-resolution body.

Changes to These Terms

We may update these Terms in response to changes in the Services, applicable law, third-party model-provider rules, or operational requirements.

The updated Terms will be published on the relevant Invideos page with a revised effective date. By continuing to use the Services after the updated Terms take effect, you agree to the revised Terms.

Where applicable law requires separate notice or consent, we will comply with those requirements.

Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will remain valid and enforceable.

Content Policy and Reporting

Do not use Invideos to create, upload or share child sexual exploitation material (including AI-generated depictions), non-consensual intimate imagery, pornography, threats, hate speech, content encouraging violence or self-harm, fraud, or content that infringes privacy or intellectual property rights.

Do not use deepfakes or synthetic media to impersonate, deceive, harass or defraud others. Obtain permission to use a real person's likeness or voice, including written authorization for commercial use. Clearly disclose AI-generated or materially altered depictions when viewers could mistake them for real events. Labeling content does not excuse prohibited uses.

We review reported content against these rules and may request additional information, restrict or remove content, or suspend access when a violation is identified. Serious safety concerns are prioritized. We may cooperate with competent authorities where required by applicable law.

To report content, email support.invideos@gmail.com without needing an Invideos account. Include the content or page URL, the reason for your report and relevant evidence. Mark urgent child-safety, non-consensual intimate imagery or credible threat reports as Urgent. Do not attach illegal imagery or unnecessary sensitive personal information.

We aim to provide a decision or progress update within 7 calendar days of receiving a report. If further investigation is needed, we will explain the next steps and expected timing. You can reply to the same email to provide more information or request a review of a decision. Reports made in good faith are welcome; reporter information is handled under our Privacy Policy.
